Subject of the Conditions
These General Conditions of Sale govern the purchase of products offered by ORTIDAMARE Srl via the website www.lamabianca.com and define the rights and obligations of the seller and the customer. Placing an order implies full acceptance of these terms and conditions.
Products and Availability
Agri-food products (including extra virgin olive oil and other local produce) are described in their respective product descriptions, which include their main characteristics, quantities, ingredients, and any allergens.
Product availability is indicated on the website and is subject to change based on seasonality and agricultural production. If the item is unavailable after placing the order, the customer will be promptly notified and can choose between replacing the product, waiting for it to be restocked, or a refund.
Prices
Unless otherwise indicated, all prices on the site are expressed in euros and include VAT. The price applied is the one indicated when the customer places the order and is considered final, subject to any corrections for obvious material errors.
Orders
An order placed through the site constitutes a purchase offer from the customer to ORTIDAMARE Srl. Receipt of the order is confirmed by email with a summary of the products purchased, prices, shipping costs, and delivery information.
The sales contract is considered concluded when ORTIDAMARE Srl confirms the order and begins processing it.
Payment Methods
The available payment methods are indicated on the order page. Website checkout. Payment is due at the time of ordering. If payment is unsuccessful, the order will be automatically canceled.
Shipping and Delivery
Shipments are made via qualified express couriers. Shipping costs and estimated delivery times are communicated to the customer before order confirmation and may vary based on destination and package weight.
Unless otherwise indicated, delivery times to Italy are generally between 3 and 7 business days from order confirmation for in-stock products. Any delays due to force majeure or courier failure cannot be attributed to ORTIDAMARE Srl.
Upon delivery, the customer is required to verify the integrity of the packaging and the correct number of packages. Any damage or anomalies must be reported immediately to the courier and communicated to ORTIDAMARE Srl within 3 business days.
Right of Withdrawal
The consumer customer has the right to withdraw from the purchase contract, without having to provide a reason, within 14 days of receiving the products, pursuant to Legislative Decree 206/2005 (Consumer Code).
To exercise the right of withdrawal, written notification must be sent to the email address info@lamabianca.com, indicating the order number and the products for which the withdrawal is intended.
The right of withdrawal does not apply to opened, partially consumed, perishable products, or products that are custom-made or clearly personalized.
Products must be returned intact, unopened, and in their original packaging. Once the returned goods have been received and inspected, ORTIDAMARE Srl will refund the amount paid within 14 days, using the same payment method used by the customer for the purchase, unless otherwise agreed.
Liability
ORTIDAMARE Srl cannot be held liable for disruptions or delays due to force majeure, unforeseeable events, or circumstances beyond its control, such as strikes, adverse weather conditions, transport disruptions, or other events that temporarily prevent it from properly fulfilling its contractual obligations.
Processing of Personal Data
The personal data provided by the customer are processed by ORTIDAMARE Srl in compliance with current legislation on the protection of personal data and as indicated in the Privacy Policy published on the website www.lamabianca.com.
Applicable Law and Jurisdiction competent
These General Conditions of Sale are governed by Italian law. Any dispute relating to the interpretation or execution of the sales contract shall be subject to the exclusive jurisdiction of the Court of the place where ORTIDAMARE Srl has its registered office, without prejudice to the consumer's mandatory rights under the Consumer Code.
